                                                        Vermiculite & Asbestos Waiver

 

Dudley Services is a highly experienced Vermiculite & Asbestos abatement contractor serving the Greater Boston Area & we have extensive experience addressing emergency vermiculite & asbestos removal procedures during times of uncertainty and unforseen unfortunate events.  

 

 In general, the Massachusetts Department of Environmental Protection (DEP) requires that all asbestos activities be notified 10 working days prior to the job commencement date.

 

However, in the event that there is asbestos or vermiculite that needs to be removed immediately and it is a hardship to wait the mandatory 10 working days required for notification, the state of Massachusetts has implemented a waiver number procedure. The steps required to obtain a waiver number are listed below:

 

​1. First, you need to call the Massachusetts Department of Environmental Protection. Two Northeast Region numbers are 1-978-815-3754 or 617-921-1152  (this serves most of the Greater Boston Area) .  The homeowner is required to call unless they are unable to be contacted, incapable of making the call, or you manage the property on their behalf. 2. You should be connected to an asbestos inspector, if not, you can leave a message on the voice mail system provided (be sure to include the information below in your message). Please keep in mind this is a state funded agency and they try to keep things as efficient as possible.  They typically can be reached after 8:45AM to 4pm Monday-Friday.  Please give them time to respond. 

 

3. When you get an inspector on the line, explain the situation/hardship (re: cracked or leaking heating system, leaking pipe, contamination hazard, unforeseen circumstance during renovation, etc.).

 

4. The inspector will ask for the property owners name, the address of the property and the amount of asbestos that requires removal at this time (most residential heating systems have 20 square feet of asbestos and about 10 linear feet or more of associated asbestos pipe insulation for standard replacements).

 

5. The inspector will then grant you a waiver number. Please remember to get the inspectors name (this is needed for the asbestos contractors notification papers). 

 

6. Once you receive the waiver number you must then call or email the licensed asbestos contractor of your choosing and present them this “waiver number” along with the inspectors name.  An asbestos contractor is required to have this waiver number before any abatement activity commences.

Please keep in mind that waiver numbers are good for 5 working days from the date they are issued.

 

7. Once the vermiculite/asbestos contractor receives this number from you, they are required to notify the Department of Labor Standards "online" and obtain a second waiver number through their system. The Asbestos Contractor should also check to see if the local health department or Fire Department requires any permitting procedures, waiver numbers or fees.  Once the asbestos contractor obtains the waiver numbers and pays the necessary permit fees then they may commence with the project.

 

If you have a question about whether a vermiculite/ asbestos contractor has performed the correct notification procedures, you could request they present you the transmittal number they received by completing and submitting form "ANF-OO1".  This transmittal number is how the state (MA DEP) keeps track of each individual abatement project. The State Program Administrators request that users not abuse the waiver system and keep its use solely for emergency purposes.
